• Protecting Your Judgment from Appeal Risk
Judgment Preservation Insurance (JPI) provides claimants with peace of mind after securing a favourable judgment or arbitral award. It protects against the financial impact of an appeal or annulment, helping to preserve the value of a hard-won damages award.

  • Winning at trial is a major milestone—but it’s not always the end of the road. Appeals can stretch on for years, introducing additional legal costs, delays, and uncertainty. For high-value cases, the risk of reversal or reduction can significantly affect a claimant’s financial and strategic position.

JPI reduces this uncertainty by locking in a portion of the award’s value, reassuring claimants, boards, funders, and shareholders that even if the judgment is overturned, financial protection is in place.

    • Once a favourable judgment or award is issued, insurers evaluate the appellate risk.

    • The insurer offers to indemnify a portion of the award (e.g. $40m of an $80m award).

    • If the appeal is fully successful and the award is overturned, the insurer pays the full insured amount.

    • If the award is reduced (e.g. from $80m to $30m), the insurer pays the shortfall up to the coverage limit (in this case, $10m).

    • Tailored Limits: Coverage available from USD $10 million to $1 billion, including co-insurance where needed.

    • Flexible Pricing: Premiums based on award size, jurisdiction, and assessed appeal risk.

    • Global Availability: Suitable for both court litigation and arbitration (including ICSID and investment treaty claims).

    • Claimant & Defendant Cover: While primarily used by claimants, coverage may also be available for defendants facing adverse appeal outcomes.
