A global litigation finance and risk management broker.

Established in 2000, TheJudge has the largest dedicated broking team in the commercial litigation funding market, with offices in London and New York.

We arrange third party funding, litigation risk sharing insurance and other finance and risk management solutions for clients involved in litigation or arbitration.

Our model is simple – we are an independent broker who acts on our clients’ behalf to structure litigation finance at no added cost to our client.

We are not just an insurance broker. We are not just a third party funding broker. We are a global litigation finance and risk management specialist, accessing over $5 billion of capital from our panel of over 40 capital and insurance providers.

We specialise in arranging:

  • Non-recourse financing for legal fees and expenses for litigation and arbitration claims;
  • Funding for individual cases or portfolios of cases;
  • Corporate financing using one or more legal claim as the security asset;
  • Insurance to cover the client’s own litigation expenditure;
  • Legal expenses insurance (After the Event) to insure adverse costs (fee shifting);
  • Security for costs bonds;
  • Solutions to cross undertakings in damages;
  • Insurance to cover the risk of award/judgment default;
  • Sale or monetization of awards or claims;
  • Award enforcement and enforcement financing;
  • M&A insurance, in particular insurance to contain legal liabilities;
  • Tailored law firm finance and insurance facility arrangements;
  • Introductions to leading law firms by specialist areas;
Why do clients engage TheJudge?
  • Quick overview and indication – Not all enquiries for litigation finance or insurance will progress to an application. We can provide a good overview of the client’s likely options within 24hrs based on a few brief details being provided.
  • No added cost – unlike other brokers, we do not charge upfront fees or finders’ fees which inflate the deal cost. We’re paid by the insurer or funder with whom we place the business, out of their income from the deal, if any.
  • We help lawyers discharge their duties – We help law firms ensure their clients receive comprehensive advice on all options in a fully transparent manner, without any risk of bias by the firm towards any particular market.
  • Saving chargeable law firm time – our work minimises lawyer time in advising on financing options, liaising with insurers and funders and managing the process from start to finish. Broking a large funding arrangement involves a large number of hours, which can often be time written off by the law firm.
  • Impartial advice and guidance – we are an independent broker acting on our clients’ behalf. We offer free, balanced, impartial advice and guidance at every stage of the process
  • High conversion rate – individual funder and insurer rejection rates can be high. Our multiple market approach and funder / insurer selection is designed to give the best chance of securing offer
  • Get the best deal – when placing insurance or funding, we run a competitive process involves approaching multiple carriers simultaneously. We aim to deliver a number of competing options to strengthen our clients’ negotiating position and get the best deal.
  • Speed – our process is designed to get from enquiry to executed funding deal in as short as timeframe as possible. We also have numerous templates, precedents and standard form agreements, all designed to save time and increase efficiency.
  • Flexibility – we access the full spectrum of options available from the international litigation finance market, so can deliver solutions on a broad range of cases, including non-monetary claims and cases where the economics may not work for traditional third party funding structures.
