White & Case Win £8 Million Judgement for Client Supported by Funding Arranged by TheJudge

TheJudge is proud to report that on Wednesday 2 July 2014 the High Court of Justice handed down a judgement for £8 million in favour of our client, family-run business Gul Bottlers. This success story demonstrates how litigation funding can help to even the playing field where a company has a good case against a well-sourced opponent but may not have the financial liquidity to pursue the matter.

Gul Bottlers is a successful bottling company run by the Leghari family in Pakistan. They manufacture and distribute Parkola beverages which include popular fizzy soft drinks like RC Cola and Sun Crest. The case concerned a dispute between Gul and global soft drinks giant Nichols over a licensing agreement entered into between the parties under which Gul was to manufacture and distribute the soft drink ‘Vimto’ in Pakistan. Vimto is a popular brand in the Middle East and Gul was expecting local production and distribution of the soft drink to be very lucrative. However, prior to production commencing Nichols erroneously terminated the agreement, denying Gul the immense opportunity to manufacture Vimto and tap into the lucrative market of Pakistan’s quickly-growing middle class population.

TheJudge was engaged by White & Case to source funding for the case. We approached multiple funders and insurers in order to secure the most competitive terms available for Gul. As is commonly the case, the responses varied enormously between Funders in both terms of their appetite to do a deal and the pricing of the terms offered.
